Terms and Conditions for Real Estate Lifeline

These Terms and Conditions (“Terms”) govern your use of the Real Estate Lifeline platform (“Platform”). By using the Platform, you agree to be bound by these Terms.

License

Real Estate Lifeline grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your own personal and non-commercial use.

User Conduct

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for all activities that occur under your account, and you agree not to impersonate or misrepresent your affiliation with any person or entity. You also agree not to engage in any conduct that could damage, disable, overburden, or impair the Platform or interfere with any other party’s use and enjoyment of the Platform.

User Content

You are solely responsible for the content that you upload, publish, or otherwise make available on the Platform (“User Content”). You represent and warrant that you have all necessary rights to grant Real Estate Lifeline the license to use your User Content as described in these Terms.

Intellectual Property

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Real Estate Lifeline, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Termination

Real Estate Lifeline may terminate or suspend your access to the Platform at any time and for any reason, including without limitation, if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. REAL ESTATE LIFELINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL REAL ESTATE LIFELINE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Indemnification

You agree to indemnify and hold harmless Real Estate Lifeline and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your User Content, your use of the Platform, your violation of these Terms, or your violation of any rights of another.

Governing Law and Jurisdiction

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms or the Platform shall be instituted exclusively in the federal or state courts located in San Francisco, California.

Entire Agreement

These Terms constitute the entire agreement between you and Real Estate Lifeline with respect to the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Real Estate Lifeline.

Changes to Terms

Real Estate Lifeline may modify these Terms at any time by posting the modified Terms on the Platform. Your continued use of the Platform after such posting shall constitute your acceptance of the modified Terms.
